Cannabinoid Legality
Since THCa is the most important, we will start with that. Beyond abbreviations, only illegal/grey-area states are written out. You can utilize CTRL+F to easily see if your state is anywhere on this list.
NOTE: This list is for purchase, possession, and usage of the cannabinoid. Not sale, as that mainly applies to storefronts operating in the state. For example, in NY you need specific licenses to sell THCa which are unrelated to the legal cannabis licenses.

THCa and Smokeable Hemp
Legal with State Cannabis Illegal - This means that while weed isn't legal, THCa is. To avoid messing up the ability for ease of CTRL-F, only initials will be used.

Grey Areas
- Colorado - In Colorado, only Type II flower is legal for partaking. This is because Colorado does not allow weed that has CBD in a higher number of 15:1 ratio to THC (Higher means less). Therefore, any flower with THCa >13% must have CBD >1%, and the percent must increase by 1 with every percent of THCa (about).
- Iowa - Their legislature is worded to heavily imply that THCa itself is illegal, but still falls into the <0.3% Delta-9. Their wording says “maximum” which implies total content, but they also specify dry weight and delta-9. It is likely illegal here.
- Ohio - Weed is legal here, but lawful hemp cannot contain 0.3% THC of any type. The grey area comes from the method of testing, which is not worded specifically enough to be sure of.
Illegal
- Arkansas - In 2023, Arkansas passed legislature that made it so THC is tested by total content, which includes THCa. Weed is still illegal in Arkansas.
- Hawaii - Specifically banned smoke-able hemp and hemp products.
- Idaho - Full ban of all weed with any THC at all.
- Indiana - Specifically banned smoke-able hemp.
- Kansas - Possession of hemp is only allowed by licensed hemp processors.
- Kentucky - Possession of hemp is only allowed by licensed hemp processors.
- Louisiana - Considers THCa as THC
- Mississippi - Considers THC after processing with heat. Specifically done on purpose for THCa.
- North Dakota - Considers THCa when testing for total content.
- Utah - Tests post-Decarboxylation.
- West Virginia - Considers THCa when testing for total content.
- Wisconsin - Considers THC after processing with heat. Specifically done on purpose for THCa.
- Wyoming - Tests post-Decarboxylation.
Illegal to Sell to
Places where legislature is defined in such a way that even though THCa is federally legal, the state laws will still hit you pretty hard if you receive it in the mail.
- Montana - Although your state has legal weed, it seems to dislike hemp products themselves. Some stores may refuse to ship to you. Check with their terms before purchasing.
- Vermont - Just like Ohio, THCa is considered unlawful to purchase. That being said, recreational weed is in Vermont - therefore, it can be considered recreational weed as well.
NOTE: While local sales are not fully included here you may see your legal state in some site's banned terms. This is because the state itself doesnt allow the sale of THCa in-state. Therefore, it is common to see Vermont, Rhode Island, and New York on some lists.
